The term of the Maharashtra Assembly ended in the last week of November.
Generally, after the assembly election results in any state, the name of the Chief Minister is announced within 1 to 7 days or the oath-taking process is also completed. Advocate Ashish Pandey says that if no party claims to form the government, then in such a situation, the governor asks the party that gets maximum number of votes to form the government. If the political party that gets the most votes cannot form the government in the state, then the governor can invite the second largest party to form the government.
What powers does the Governor have if the government is not formed?
If there is a long delay in the formation of the government in the state, then the Governor definitely has the right to recommend the imposition of President’s rule. This situation is also called “State Emergency” or “Constitutional Emergency”.
Article 356 of the Constitution of India says that the rule of the President is imposed when the President, after receiving a report from the Governor, is satisfied that the government of the State cannot be carried on in accordance with the provisions of the Constitution. Initially, the President’s term is valid for 6 months, but if necessary, it can be extended from 6 months to a maximum of 3 years.
This situation is not visible in the case of Maharashtra, but it is stated that the name of the Chief Minister will be revealed in the next two days.
