Uttar Pradesh: The Bahraich case was heard in the Lucknow bench of the Allahabad High Court on Wednesday. During this, the court heard from both sides. Following this, the court has ordered both parties, the government and the victims, to submit their respective evidence and documents in the case. The next hearing in the case will be on November 4. Until then the ban on using excavators will continue.
Earlier on October 20, the Allahabad High Court, while hearing the case, had banned excavator operation for 15 days. The 23 houses or shops on which the PWD department pasted the notice were given a period of 15 days to submit their response. PWD had pasted notices on the houses and shops of 23 people, including Abdul Hameed, the main accused in the violence in Bahraich. The notice was issued by the department regarding removal of encroachment on government road.

At the same time, after the Bahraich violence, a petition was filed with the Supreme Court to ban the proposed action on the bulldozers. The Supreme Court will on Wednesday hear the plea of three accused in the Bahraich communal violence case against the demolition notice. Senior advocate CU Singh, appearing for the petitioners, mentioned the matter before a bench comprising Justice BR Gavai and Justice KV Vishwanathan and sought urgent hearing.
Advocate CU Singh told the court: “This is a petition by three people who have received demolition notices. The state government has given only three days to respond to the notice.” Singh said that the father and brothers of petitioner number one surrendered and the notices were allegedly issued on October 17 and were posted on the night of the 18th. He said, “We had requested a hearing on Sunday, but it could not be held.” Additional Solicitor General KM Nataraj, appearing for the Uttar Pradesh government, told the court that the Allahabad High Court had considered the matter and had issued a 15-day notice to respond.
