No relief for Muslim side in Somnath bulldozer action, SC said: govt to remain in possession of land

Supreme Court.

A hearing was held in the Supreme Court on Friday in the Gir Somnath bulldozer action case in Gujarat. During this time, the high court refused to pass any order. The high court said it is government land. The bench of Justice BR Gavai and Justice KV Vishwanathan said the possession of the land will remain with the government until further order and will not be allotted to any third party.

Kapil Sibal presented arguments on behalf of the Muslim party and stated that these are protected monuments. Without rights of any third party. Regarding this, Judge Gavai said, what are the rights of third parties? This is government land. The High Court is aware of the matter. Sibal said this is contempt of his order. Sibal said the reason given for the demolition is that those monuments are near the Arabian Sea and cannot be near a body of water. Protected monuments were demolished. Can you imagine this despite your request?

On this argument of Sibal, Solicitor General Tushar Mehta said that there was no protected monument. Justice Gavai said that this High Court order was passed in 2015. You can use the land only for the stated purposes.

SC records SG statement in order

SG says the possession of the land will remain with the government until further orders and will not be allotted to any third party. In such a situation, we do not consider it necessary to pass any interim order.

Contempt petition has been filed in SC

A contempt petition has been filed before the Supreme Court in the case of an excavator action near the Somnath temple. It has been said that despite the Supreme Court’s order to stop the excavators, large-scale demolition work has been carried out. Contempt action has been sought against the collector and other officials of Gir Somnath.
