In fact, Jitendra Prasad, a resident of Kothia, had filed a complaint with the State Election Commission claiming that Saba Khatoon has citizenship of Bihar and Nepal.

Jitendra Prasad, while giving information about dual citizenship under sections 135 and 136 (2) of the Bihar Panchayat Raj Act, 2006, had demanded the removal of Saba Praveen, who was the chief till now, from the post of chief. It is clear that as per Section 136 (1) of the Bihar Panchayat Election Act, 2006, it is mandatory to be a citizen of India to participate in the Indian electoral process.

After Jitendra Prasad made allegations, the State Election Commission had sought information about the situation from Saba Khatoon. About which Saba Khatoon said that after her father’s death, she had gone to her maternal grandfather’s house in Nepal for some time and soon returned to her ancestral home in Bihar. However, he could not answer: How was the name, photograph and voter ID published in the citizenship register of Nepal? He had also told the Commission that he had written literate in his nomination form, while he had passed the Matriculation equivalent examination. In this way the facts have been hidden by them.

No proof of Indian citizenship found

Jitendra Prasad submitted before the Commission that the Patna High Court confirmed in the Kiran Gupta case that land acquired in India, name in voter list, PAN card, Aadhar card and educational certificate, etc., are not They are proof of Indian Citizenship. Mother of Saba Khatoon, resident in Nepal

When these allegations were made by Jitendra Prasad. Subsequently, Saba Khatoon submitted before the Commission that she is a citizen of India by birth and origin. He also said that his mother is a Nepali citizen and his father is an Indian citizen. After his mother’s marriage, he came to live in India, his father died in 2007, so he stayed in his maternal grandfather’s house in Nepal for a short time, but it was a very short stay. His ancestral home has been India since the beginning and all his family and relatives, including his grandfather, currently reside in Bihar.

In support of her claim, Saba Khatun also got the State Election Commission to check the photocopy and genealogy of Khatian from the year 1898. She also told the Commission that it is clear from the said plot and family tree that her ancestral family is a resident original and permanent of India. However, he also told the Commission that his mother Ahmadi Khatoon had participated in the Panchayat elections in the year 2016. The voter ID card is also available with them. From the beginning till now his family people reside in India.

In this regard, he also presented the certificates of Focania, considered equivalent to tenth, and Vastaniya, considered equivalent to eighth, issued by the Bihar State Madrasa Education Board, Patna. Along with this, documents like Aadhar card, voter ID card issued by Election Commission of India and residence certificate issued by Darbhanga Sadan Sadar sub-divisional office were also submitted. It was also stated that he has resided in India since his birth.

He also told the Commission that as soon as he learned that his name was included in Nepal’s citizenship list, he requested to be removed from there immediately. After this, on March 3 this year, his name was removed from the citizenship list of Nepal. He told the Commission that possibly because his mother was a Nepali citizen, his name could have been included in the Nepali Voter List and the Nepali Citizenship List under the provisions of the Citizenship Act.

Apart from all this, all the facts of both the parties were also presented before the State Election Commission, after observing which the State Election Commission clarified that till the date of scrutiny, Saba Praveen alias Saba Khatoon was not a citizen of India, which This is clear from the indisputable documentary evidence and its acceptance. Thus, despite being qualified under section 136(1) of the Bihar Panchayat Raj Act, 2006, he contested the elections on the basis of a false affidavit while concealing the facts and won the post of district chief of Gram Panchayat Kothia, Darbhanga. Which is not only legal but also illegal.

Therefore, by virtue of the powers granted under the relevant sections of the Bihar Panchayat Raj Act, 2006, Saba Praveen alias Saba Khatoon is relieved of the charge of Gram Panchayat Mukhiya with immediate effect. At the same time, the Commission has also made it clear to the District Magistrate of Darbhanga that for concealing facts and filing false affidavit, under the provisions of relevant sections of the Bihar Panchayat Raj Act, 2006 and other relevant sections and despite not being Indian Necessary legal action against Saba Khatoon for participating in elections in India should be ensured under relevant sections.
