The Haryana government has withdrawn its two bills. Chief Minister of State Naib Singh Saini on Monday moved proposals to withdraw both the bills in the Assembly. The Central Government had pointed out some flaws in both the bills. Following this, the Haryana government withdrew both the bills. One of these bills was about organized crime and the other was about protesting by keeping bodies on the roads. Now both bills will be amended. After this they must be presented again in the Assembly. After being approved in the Assembly, both bills will go back to the Central Government for review.
The special thing is that the Haryana Government has been trying to pass the Haryana Organized Crime Control Bill since 2019, but the Center has returned it three times so far.
The bill was passed in the Khattar government.
In March last year, the Assembly passed the Haryana Control of Organized Crime Bill, 2023, which aimed to prevent and control criminal activities by organized gangs. This bill was reintroduced after the government made some changes. Earlier, the Haryana government had withdrawn the Haryana Control of Organized Crime Bill, 2020 after the Center pointed out “certain anomalies”. At that time it was concluded that certain provisions of the withdrawn bill would conflict with certain provisions of the Law on Narcotic Drugs and Psychotropic Substances.
The Ministry of the Interior rejected the bill.
The 2019 version of this bill was also withdrawn following (the Centre’s) comments on certain provisions. After being approved by the Assembly, the 2023 bill was sent to the governor, who reserved it for the president’s approval under Article 201 of the Constitution. This bill was then sent to the Union Home Ministry. When this bill was sent to the Ministry of Law and Justice, the Ministry of Finance and the Ministry of the Interior for their opinion, they pointed out some discrepancies. The Ministry of Home Affairs asked Haryana to withdraw this bill and re-introduce it after incorporating some suggestions from the Legislative Department of the Ministry of Law. The issue was discussed and it was decided to bring a revised bill in view of the comments made by the Centre.
What was the suggestion of Congress?
Congress had suggested that the 2023 bill should be sent to a House select committee. Congress leader Bhupendra Singh Hooda said in the House on Monday that his party had earlier demanded that this bill be withdrawn. His party MLA BB Batra said, “This is the third time this bill has been withdrawn,” House leader Saini said a new version of the bill with changes will be introduced in the House. On Monday, the government also withdrew the Haryana Dead Body Disposal Bill, 2024, which was passed by the Assembly in February this year. The corpse disposal bill provided for punishments for those who used corpses for display. This bill was sent to the Governor, who reserved it for the approval of the President. The Home Ministry later sought clarification from the State on the comments made by the Union Health Ministry. (PTI input-language)
