The High Court opposed the affidavit filed by the Additional Chief Secretary (Finance) of the Government of Uttar Pradesh. In which he had sought exemption from the presence of the court for having to attend a program in which the Chief Minister was present. Expressing objection to this affidavit, the High Court cautioned the Additional Chief Secretary Finance. The court said if the court orders are not complied with on the next scheduled date, strict action will be taken against them.

“The proceedings of the court should not be delayed due to a schedule fixed by some other constitutional authority in which the contemnor considers his presence necessary,” Justice Salil Kumar Rai said in his order. Single Judge Laxman Prasad was considering the contempt petition filed by Kushwaha in 2009 for non-compliance with a high court order directing officials to clear his salary and salary arrears.

When the Additional Chief Secretary (Finance) of the UP government sought an exemption on the ground that he was required to be present at the inauguration program of the scheme called Mission Shakti, Phase 5, which was attended by the Chief Minister, the court condemned the request because it was observed that the allegation was not such that it could excuse his absence!!

However, in view of the high position of the Additional Chief Secretary (Finance), the Court condoned the absence of the Additional Chief Secretary (Finance) and warned him that strict action would be taken against him if the Court’s orders were not complied with by the Court. the next set date. Thereafter, as a last resort, the Court directed all officials concerned to comply with the order passed by the Writ Court and file affidavits of compliance before the next fixed date (November 11) or appear in person to frame the charges. .
