In Uttar Pradesh, property and proceeds of crime will now be distributed from criminals to victims. The DGP has issued SOPs to the SSP, SP and police commissioner of all districts. Under this, the police will confiscate assets acquired through crimes from mafia and criminals in the state.
The assets will be confiscated by order of the court. The income obtained from the seizure of assets will go to the victims. By order of the court, within two months the district DM will auction the property acquired through crime and distribute it among the people affected by the crime.
Until now, the UP government was confiscating mafia properties under the Gangster Act and constructing government houses. Under Section 107 of BNSS, police can now directly seize property even without a case under the Gangster Act or the PMLA Act.
According to article 107 of the BNSS, the police will apply directly to the court to seize and confiscate the property of any criminal. Before seizing the property, the police will also have to provide the court with the complete details of the owner’s or offender’s bank account, income, income tax return and purchase of the property.
The owner must respond within 14 days
After the court hearing, the court will give instructions to distribute the proceeds from the seizure of assets to the people affected by the crime. Within 60 days, the DM of the concerned district will distribute the proceeds from the seizure of assets to the affected persons. At the same time, the owner or the offender must respond to the application submitted by the police to the court within 14 days. If no response is given within 14 days, the court will make an ex parte order.
Currently, UP DGP Prashant Kumar has issued SOP to officials of all districts to auction the property acquired through crime and distribute it among the victims as per the new law.
It is noteworthy that earlier in Prayagraj apartments were built on land illegally occupied by the Atiq Ahmed mafia under the Prime Minister’s Housing Scheme for the Poor. In Lucknow too, an apartment is being built on the land acquired by Mukhtar Ansari. Now the income obtained through the confiscation and confiscation of the properties of the big mafias, as well as their assistants and petty criminals and gangsters, will be distributed among the victims.
