Punjab-Haryana High Court News: Petition filed against grant of pension to former CM Chautala

The High Court issued a notice seeking response
Former president Satbir Kadian, Ajay Chautala and Sher Singh Badshami were also accused.
Chandigarh News (Aaj Samaj) Chandigarh: A petition has been filed in the Punjab and Haryana High Court against the pension given to former Haryana CM Omprakash Chautala. The petition expresses protest against the continuation of pension given to former CM Omprakash Chautala, former President Satbir Kadian, former MP Ajay Chautala and Sher Singh Badshami. The petition says that even after the court’s verdict, these honorable people receive pension. Taking cognizance of the petition, the High Court has issued notice to all and asked them to file their reply. The petition has been filed by Harichand Arora, a resident of Chandigarh.

Arora said he had sought information from the Assembly Secretariat under the Right to Information Act regarding the pensions of former MLAs. In which it was revealed that pension is being paid to four convicted former MLAs. He said the High Court has asked all honorable people why their pension should not be suspended. Arora said during the debate in the High Court that as per Section 7-A (1-A) of the Haryana Legislative Assembly (Salary, Allowances and Pensions of Members) Act, 1975, if the court sentences any MLA, then he does not have the right to pension. Let’s go.

Harichand Arora said that before the High Court he had filed a petition before the Assembly Secretary for not granting pension. But the Assembly Secretary said the former MLA is entitled to pension under the Salaries, Allowances and Pensions Act. His membership was not canceled under the anti-defection law nor was he disqualified under the Representation of the People Law.

Father and son of Chautala sentenced to 10 years

The petitioner claims that Omprakash Chautala, Ajay Chautala and Sher Singh Badshami were sentenced to 10 years in prison on December 16, 2013 on corruption charges. Satbir Kadian was also sentenced to seven years on August 26, 2016. Therefore, it is illegal for them to receive pension.
