4pm News Network: Great news comes out of the Supreme Court. Today the Supreme Court issued a historic decision. The Supreme Court has rejected petitions challenging the inclusion of the words “socialist” and “secular” in the Preamble of the Constitution under the 42nd Amendment passed in 1976.
In this case, a division bench of Chief Justice of India (CJI) Sanjiv Khanna and Justice Sanjay Kumar said that Parliament’s power of amendment also extends to the Preamble. The date of adoption of the Preamble does not limit Parliament’s power to amend the Preamble. On this basis the retroactivity argument was rejected. Let us tell you that CJI Sanjeev Khanna further said that the process cannot be canceled after so many years. In addition to this, the decision also explained what is meant by “socialism” and “secularism.” So many years have passed, why is this question being raised now?
important point
- CJI Khanna stated that the way of understanding socialism in India is very different from that of other countries. In our context, socialism primarily means a welfare state… that’s all.
- The term socialism is used in a different context, meaning that the state is a welfare state.
- It should defend the welfare of the people and provide equal opportunities.
