Beant Singh was the former Chief Minister of Punjab, he was murdered in the year 1995. Balwat Singh Raza was convicted in this murder case. A bench comprising Justice BR Gavai, Justice PK Mishra and Justice KV Vishwanathan adjourned hearing on Balwant Singh Rajaona’s petition for two weeks. The petition said that due to the excessive delay in making a decision on his clemency petition, his death sentence should be commuted to life imprisonment. On September 25, the top court had sought a response from the Centre, the Punjab government and the Chandigarh Union Territory administration to Rajoana’s petition. It may be noted that on August 31, 1995, the then Punjab Chief Minister Beant Singh and 16 others were killed in the explosion at the entrance of the Civil Secretariat in Chandigarh. In this case, in July 2007, a special court found Balwant Singh Rajoana guilty and sentenced him to death. In March 2012, the Shiromani Gurdwara Parbandhak Committee (SGPC) had filed a mercy petition on his behalf before the Supreme Court under Article 72 of the Constitution. On May 3 last year, the Supreme Court refused to commute Rajoana’s death sentence, saying only the competent authority could consider the mercy plea.

The petition has been pending before the President for 12 years

Solicitor General Tushar Mehta, appearing for the Centre, told the court that Rajoana’s mercy plea was pending in Rashtrapati Bhavan, following which the court asked him to decide either way or we would consider it (Rajoana’s plea). Demanding Rajoana’s release until a decision is taken on the mercy petition, Rajoana’s senior lawyer Mukul Rohatgi said Rajoana has been in continuous custody for 29 years. Rohatgi said his mercy petition is pending at Rashtrapati Bhavan for the last 12 years. Please release them for six or three months. At least let them see what the outside world is like. The Punjab government told the court that they need some time to file their counter affidavit in the case.
