Following this decision of the Supreme Court, thousands of students studying in madrassas in Uttar Pradesh have got relief. The Madrasa Education Act, 2004 was declared unconstitutional by the Allahabad High Court and the Supreme Court overturned the earlier decision. The Supreme Court’s decision was welcomed by the Muslim population of Moradabad district.

But in the decision made, Kamil’s course that was equivalent to graduation was abolished. He says we want to appeal to the Supreme Court to reconvene a higher court and review the sentence. He said the Supreme Court had said in its decision that all madrassas are constitutional.
“Kamil-Fazil’s decision goes against the right to equality”
He said that studies in madrassas are completely legitimate, as are studies in secondary schools. The court has declared the courses offered for high school and intermediate level appropriate. But the courses that were equivalent to graduation and postgraduate studies have been abolished. Haji Waqi demands from the Supreme Court that this does not happen. Explaining the reason, he said that this decision goes against the right to equality. There is a violation of article 14.
‘If Acharya’s title is correct, why is Kamil-Fazil’s title incorrect?’
Haji Waqi Rashid (advocate) said that if everyone has been given equal rights in our Constitution, why don’t we have them? When someone can become an Acharya and the degree of Acharya he obtains, that graduation will be equivalent to graduation. We have no objection to that. Is it not right for Kamil to get a degree from our Madrasa? Why is this happening? He said that a special review should be completed. He said that just as many courses are being given for the people of the Hindu community, the same courses should also be given for the Muslims.
Demand for action against those who go to the High Court against madrassas
He said there was a Rathore Saheb. They thought he would go to court and close the madrasa. Does anyone think I’ll turn the Taj Mahal into Teju Mahal! Someone goes to court to change the name of Qutub Minar. He says this is an abuse of the law. Such people should be punished and legal action should be taken against them. He says that these people are spoiling the country’s environment. They are misusing the law and the country’s constitution. Rathore Saheb has wasted the court’s time; action must be taken against him.
