The Supreme Court has set aside the order of the Rajasthan High Court, in which sexual harassment cases were quashed on the basis of an agreement. Justice CT Ravikumar said in a decision that this controversial order of the Rajasthan High Court is cancelled. FIR and criminal proceedings will be carried out as per law. We have no comment on the merits of the case and greatly appreciate the amicus’ services.

The Supreme Court said that this crime falls under the non-compromising section. In such a situation, the order of the High Court is not appropriate. The court has taken this decision while hearing the case of a 15-year-old girl. An appeal was filed before the Supreme Court in the case of harassment of a minor.

The matter will be investigated again

In this case, a case was registered following a complaint by the father of harassment of a minor. The first information report was filed on the same complaint. Later, after conversations between the accused and the victim, an agreement was reached. The accused filed an appeal before the High Court in this sexual harassment case. The Rajasthan High Court closed the criminal case against the accused after the hearing.

In this case, the objection was filed before the Supreme Court by a third party. In the petition filed before the Supreme Court on behalf of petitioner Ramji Lal Bairwa, it was asked whether the High Court can cancel the use of powers granted under section 482 of the CrPC in the case of sexual harassment. It was asked whether the sexual harassment case can be put to an end by reaching a compromise between the accused and the victim. The Supreme Court said it will investigate this matter. The Supreme Court said that this decision of the Rajasthan High Court is not correct.
