The Lucknow Bench of the Allahabad High Court has canceled the adjustment of core teachers in UP. The court has ordered to stop all activities related to the adjustment process and correct the errors. The adjustment process was directly affecting around 80% of the state’s schools, so education was being affected in large numbers.

Thousands of teachers took a big hit
The High Court has considered the adjustment process in the Department of Basic Education as a violation of Articles 14 and 16. This order of the Allahabad High Court has come as a blow to thousands of teachers in the state. After this order, the adaptation process underway in the schools of the state Department of Basic Education has been affected. In such a situation, thousands of teachers in the state who were expecting an adjustment received a great shock.

For example, one school has 10 teachers, another school has 3 teachers, where there are 10 teachers, 8 are needed. Until now, it has happened that where there are 10 teachers, 2 teachers are removed and placed in another school with a smaller number of teachers. What happens in the adjustment is that the teacher who is assigned later is eliminated first. Whereas what should be there should have been removed. There was a debate on this matter. Which has been canceled by the court. The court has said that you have to make a policy first and then adjust it.
The court has taken an important decision regarding the adjustment process being carried out in the Department of Basic Education of Uttar Pradesh since 2011. The court has found that the “last in, first out” rule implemented in this process goes against articles 14 and 16 of the Constitution. This means that new teachers always have a lower priority and are excluded from the transfer policy, while veteran teachers remain posted in one place for a long time. The court has passed this order in the case of Reena Singh and others vs. State of Uttar Pradesh. The court believes this process is unfair to junior teachers and benefits veteran teachers.
