The Allahabad High Court approved the bail of Irfan Solanki, MLA from Kanpur seat of Sisamau, but did not stay the sentence, meaning his MLA position will not be reinstated. With this decision, the way has been cleared for the by-elections in the Sisamau seat of Kanpur, where by-elections will be held on the fixed date of November 20.
The division bench of Justice Rajeev Gupta and Justice Surendra Singh took this decision. Once the hearing in this case was over, the court had reserved its decision for November 8. The Kanpur MP MLA Special Court had announced the punishment on June 7 this year by holding many people, including Samajwadi Party MLA Irfan Solanki, guilty.
Solanki was convicted in this case
MLA Irfan Solanki and his brother Rizwan Solanki were sentenced to seven years in prison. The Solanki brothers were convicted and sentenced for setting fire to a woman’s house. Due to the seven-year sentence, Irfan Solanki’s membership was cancelled. Irfan Solanki had challenged the trial court’s decision before the Allahabad High Court.

The appeal sought to suspend the decision of the court of first instance and grant bail until the court’s final decision. The Supreme Court had also last month asked the Allahabad High Court to complete the hearing in this case and give its verdict within 10 days. In this matter, the UP government had also filed an appeal before the High Court.
The UP government had appealed to increase the punishment.
While Irfan Solanki’s appeal sought to quash the sentence, the UP government’s appeal sought to increase the sentence from 7 years to life imprisonment. However, following the government’s appeal, the court has not made any decision to increase the sentence. Even after getting bail, Irfan Solanki will not be able to come out of jail.
