Aadhaar card is undoubtedly a very important document, but when it comes to determining age in a particular situation, Aadhaar card is not a valid document for that. The Supreme Court has issued this decision during the hearing of a case. According to Bhasha News, in fact, the Supreme Court on Thursday canceled the Punjab and Haryana High Court’s order accepting Aadhaar card for determining the age of a person who lost his life in a road accident for awarding compensation. .

This is not proof of date of birth.

According to the report, a bench of Justice Sanjay Karol and Justice Ujjal Bhuiyan said that the age of the deceased should be determined from the date of birth mentioned in the school leaving certificate under section 94 of Juvenile Justice (Care and protection of children). Act of 2015. The court noted that we find that the Unique Identification Authority of India, in its Circular No. 8/2023, with reference to an office memorandum issued by the Ministry of Electronics and Information Technology dated 20 December 2018, stated that to establish an Aadhaar identity card it can be used for date of birth but is not proof of it.

Age was calculated as

The Supreme Court accepted the appellants’ argument and upheld the decision of the Motor Accident Claims Tribunal (MACT), which had calculated the age of the deceased on the basis of his school leaving certificate. The high court was hearing an appeal filed by the relatives of a man who died in a road accident in 2015. MACT, Rohtak had ordered compensation of Rs 19.35 lakh which the High Court reduced to Rs 9.22 lakh after note that MACT had erroneously applied the age multiplier when determining compensation.

Based on the Aadhaar card of the deceased, the High Court had estimated his age at 47 years. The family argued that the High Court had committed a mistake in determining the age of the deceased on the basis of the Aadhaar card because if his age was calculated based on his school leaving certificate, he was 45 years old at the time of his death.
