Team India head coach Gautam Gambhir had a huge relief ahead of the Perth Test. The Delhi High Court has stayed the decision to charge him in an old fraud case. Gambhir was actually acquitted earlier in this case, but the special judge overturned the lower court’s decision and again charged him and ordered an investigation. But now the Delhi High Court has stayed the special judge’s order. The coach of the Indian team was accused of being involved in fraud with home buyers through a company.
Gambhir had filed the petition
When the Sessions Court re-indicted Gautam Gambhir, he approached the Delhi High Court. The Indian team coach filed a petition against the special judge’s order. Now, after the hearing, the verdict has been handed down in his favor. On Gambhir’s plea, the High Court has also sought a response from the Delhi government on the possibility of re-indicting him after his acquittal by the Magistrate’s Court.
According to the PTI report, the flat buyers had filed a fraud case against real estate companies Rudra Buildwell Realty Pvt Ltd, HR Infracity Pvt Ltd, UM Architecture and Contractors Ltd and Gautam Gambhir. Gambhir was the director and brand ambassador in the joint venture of all these companies. However, Gambhir was acquitted by the trial court. The case later reached the Sessions Court, where Special Judge Vishal Gogane, who was hearing the case, found that Gambhir was the only accused who had direct contact with the investors as a brand ambassador. Therefore he had given orders to re-indict him.
The main reason for charging Gambhir
According to special judge Vishal, the court found that Gambhir engaged in financial transactions with the company beyond his role as a brand ambassador. According to the court, Gambhir was Additional Director from June 29, 2011 to October 1, 2013, i.e. when he joined the company as a director, this incident took place. Apart from this, there was some give and take even after he resigned from the post on October 1, 2013. Hence he revoked the previous decision.
Apart from this, the special judge found that it was not clear from the charge sheet whether any part of the fraud amount reached Gambhir or not. Despite this, he was acquitted. For this reason, he had given orders to charge the head coach of the Indian team again. He had said in his decision that there was no mention in the lower court’s decision of Gambhir giving Rs 6 crore to Rudra Buildwell Realty Private Limited and receiving Rs 4.85 crore from the company.
