Tokyo: The High Court has handed down an important decision on gay marriages in Japan. This decision has been a hard blow for homosexual couples. Another high court on Wednesday declared the government policy banning gay marriage unconstitutional. The Tokyo High Court said the gay marriage ban is “unfounded legal discrimination based on a person’s sexual orientation.”
He said the ban violates the right to equality, as well as the dignity of people and constitutional guarantees of gender equality. Previously, a Sapporo High Court ruling in March said that not allowing gay couples to marry and enjoy the same benefits as civil couples violates their fundamental right to equality and freedom of marriage. The Tokyo High Court on Wednesday became the seventh court in Japan to rule that the current gay marriage ban is unconstitutional or similar. Only one district court in the country has declared the ban on gay marriage constitutional. However, these orders can be challenged before the Supreme Court.
